By accessing or using the EmployNext Alberta website, Resource Centers, communications channels, authorized digital service platforms, or any service component made available by EmployNext Alberta, you agree to these Terms of Service and our Privacy Policy. 1. Introduction
These Terms of Service (the “Terms”) govern access to and use of EmployNext Alberta’s website, online resources, authorized digital platforms, Resource Centers, communications channels, and related services, tools, supports, and features made available by EmployNext powered by Serco Canada Inc. (“EmployNext Alberta,” “EmployNext,” “we,” “our,” or “us”). They apply to all users and others who interact with EmployNext Alberta, including participants, employers, community organizations, service providers, and partners.
Some services and features are broadly available to the public, while others are available only to people who meet the eligibility requirements for the applicable Alberta service or component.
We may modify, suspend, improve, restrict, or discontinue any part of the Services at any time. Where feasible, we will provide reasonable notice of material changes, but changes may take effect immediately where required for legal, privacy, security, operational, accessibility, safety, or performance reasons.
Where a feature, form, account, or service workflow presents or refers to these Terms at the point of use, your continued access, submission, registration, or participation constitutes acceptance.
Your continued use of the Services after the revised Terms take effect constitutes your acceptance of those revised Terms
2. EmployNext Alberta
EmployNext Alberta supports access to information, navigation, employment-related services and wrap around service referrals under the guidance of the Alberta Government. Depending on the service or component, this may include public-facing information resources, Resource Centers access, assessments, Action Planning, follow ups, employment readiness supports, disability-related supports coordination, community and wraparound referrals, employer-connected functions, and other authorized service activities.
Some Alberta program components are delivered through referral-based or eligibility-based models and may involve coordination with the Government of Alberta, approved systems, Employment Services Providers, community agencies, wraparound-support providers, and other authorized partners.
3. Eligibility, Access, and Use
You must meet the eligibility requirements for the applicable Alberta service or component you are using.
Some services are public-facing, while others may require referral through an approved Alberta process or system, confirmation of identity or eligibility, consent or authorization, intake or assessment steps, or compliance with program rules and participation expectations.
If you access or use any part of the Services on behalf of another person, you represent that you are authorized to do so where legally permitted.
We may limit, suspend, or refuse access to a service, location, account, feature, or communication channel if eligibility or authorization cannot be confirmed, applicable requirements are not met, there are privacy, security, misuse, fraud, or operational concerns, or restrictions are needed to protect staff, participants, partners, or the integrity of the Services.
4. Collection, Use, and Disclosure of Personal Information
By using the Services or participating in an Alberta service component, you acknowledge that EmployNext Alberta may collect, use, document, store, review, and disclose personal information as reasonably necessary to deliver authorized services, communicate with you, coordinate referrals and supports, maintain records, and meet legal, contractual, audit, accountability, privacy, security, and operational requirements, all in accordance with our Privacy Policy and applicable law.
We will make reasonable efforts to collect, use, and disclose only the minimum personal information reasonably necessary for the applicable service, program, legal, operational, or reporting purpose.
Where required by law, policy, or practice, EmployNext Alberta will seek express consent for non-routine, or more highly sensitive disclosures.
5. Alberta Privacy and Access Requirements
Personal information handled in connection with EmployNext Alberta may be subject to Alberta privacy and access requirements, including the Protection of Privacy Act (POPA), the Access to Information Act (ATIA), and other applicable legal, contractual, or program requirements.
Records of personal information collected under applicable Alberta contracted service models will be stored only in Canada.
If approved processes require that access, correction, review, or complaint requests follow a specific route, EmployNext Alberta may direct those requests through the appropriate internal or external process.
6. Resource Centers, Website, and General Information Services
EmployNext Alberta may provide public-facing website content, Resource Centers access, labour-market information, career and employment information, digital tools, print materials, workshops, forms support, and general navigation services.
Public-facing information and Resource Centers services are provided for general informational and navigation purposes only. Access to those services does not guarantee eligibility for any funded Alberta program or service component.
We may revise, remove, or update website content, resources, tools, or service options at any time.
7. Service Records and User Content
If you participate in a program-related service component, EmployNext Alberta staff may create and maintain records such as Action Plans, referrals, case notes, assessments, follow-up records, attendance information, outreach documentation, accommodation information, and progress updates.
You may provide information such as your name, contact information, résumé, work history, education, goals, preferences, barriers, accommodation needs, eligibility information, supporting documents, and other information relevant to your use of the Services (“User Content”).
You retain ownership of the original documents and content you provide to us, but you grant EmployNext Alberta the right to use, copy, store, review, and disclose that information as reasonably necessary to deliver services, maintain records, coordinate supports, meet legal and contractual obligations, and carry out the purposes described in these Terms and our Privacy Policy.
We retain records only as long as reasonably necessary to deliver services, operate the Services, and meet legal, contractual, reporting, audit, privacy, security, and operational requirements, or as otherwise described in our Privacy Policy or required by law.
8. Referrals, Service Coordination, and Information Sharing
To support service navigation, referrals, coordination, or program administration, EmployNext Alberta may interact with the Government of Alberta, Employment Services Providers, community agencies, wraparound-support providers, disability-related supports providers, training organizations, employers, and other authorized partners, as appropriate to the service or component being used.
These interactions may include service planning, case conferencing, intake coordination, referral management, progress follow-up, retention support, accessibility planning, accommodation coordination, and related service functions.
Where a referral, case conference, coordinated support, or service connection requires disclosure of highly sensitive, material, or non-routine personal information, EmployNext Alberta may seek separate consent or written authorization where required by law, policy, or practice.
We will make reasonable efforts to limit information sharing to the minimum amount necessary for the intended purpose.
9. Accessibility, Accommodations, and Inclusive Service
EmployNext Alberta is committed to inclusive, accessible, trauma-informed, culturally responsive, and respectful service delivery.
You may request reasonable accommodation(s), alternate formats, communication supports, accessibility tools, or service adjustments at any time. We will make reasonable efforts to work with you and, where appropriate, with authorized providers or partners to support equitable participation in the Services.
Accessibility options may vary depending on the service, feature, mode of delivery, program requirements, and operational limitations. Requests for accommodation(s) will not negatively affect eligibility for services
10. Communications and Notifications
Depending on the service, feature, or component you use, EmployNext Alberta may communicate with you by phone, voicemail, text message, email, mail, virtual meeting tools, secure messaging tools, website notices, or in person.
Communications may include appointment reminders, service updates, follow-up requests, workshop or event information, responses to inquiries, referral coordination messages, and notices relating to policies, privacy, security, consent, records, or service changes.
You are responsible for providing reasonably accurate contact information and keeping it current if you want to receive service-related notices and updates.
Where required by law or policy, we will obtain any necessary communication consent. You may also be able to update preferences for certain non-essential communications.
11. LMI, Job Postings, and Third-Party Resources
EmployNext Alberta may provide access to labour-market information, job postings, employer opportunities, referral information, educational resources, government forms information, digital tools, or links to third-party websites, services, or content.
Third-party content, postings, links, and tools may change without notice and may not always be complete, current, accurate, accessible, available, or under our control.
If you choose to access a third-party tool, resource, or external website made available through or linked from the Services, that third party may have its own terms, notices, and privacy practices.
EmployNext Alberta does not guarantee interviews, placements, job offers, funding, acceptance into another program, or any employment, education, training, or service outcome resulting from use of the Services.
You should use your own judgment and verify important information with the original source where appropriate.
12. Acceptable Use
You agree not to use the Services in any way that violates applicable law, infringes the rights of others, threatens safety, compromises privacy or security, interferes with service delivery, or misuses staff time, systems, facilities, employer contacts, or partner information.
This includes uploading malware, attempting unauthorized access, probing or scraping non-public systems, impersonating another person, submitting misleading or fraudulent information, sending spam or deceptive communications, harassing or threatening others, or using the Services to build competing systems or datasets without authorization.
You also agree to treat staff, volunteers, peers, employers, providers, and partners respectfully and to refrain from threatening, abusive, discriminatory, violent, or otherwise unsafe conduct in connection with the Services, Resource Centers, staff, employers, or partners.
We may monitor use for privacy, security, fraud prevention, safety, quality, accessibility, compliance, audit, and service-improvement purposes, subject to applicable law and our Privacy Policy.
13. Accounts, Security, and Service Availability
Some online features, tools, portals, or service components may require account access, identity verification, secure links, unique credentials, or other access controls.
You are responsible for using any provided credentials, links, access methods, or devices appropriately and for notifying us if you believe your account, communications, or information may have been compromised.
We aim to provide reliable and secure Services, but we do not guarantee uninterrupted, error-free, accessible, or always-available operation. Maintenance, outages, upgrades, emergency changes, accessibility updates, and third-party disruptions may occur without notice.
From time to time, we may provide new, beta, pilot, limited, or trial features. Those features may be changed, suspended, or withdrawn at any time and may be subject to additional notices or conditions.
14. AI-Assisted Features and Automated Supports
EmployNext Alberta may use approved AI-assisted, automated, recording, transcription, summarization, or analytics-supported tools to support authorized service delivery, documentation, navigation, communication, accessibility, quality assurance, or related administrative functions. AI-assisted tools may assist with drafting or summarizing information, but final decisions remain subject to human review where required
These tools are assistive only. They do not replace staff judgment, professional responsibility, program rules, or human review.
AI or automated tools will not make final decisions about eligibility, benefits, access to services, participation status, or any other matter that directly affects an individual without appropriate human review and required authorization.
Personal information will not be entered into unapproved AI tools or non-approved services. Approved AI-related uses involving personal information must be subject to privacy, security, and governance controls.
AI-assisted outputs may be incomplete, inaccurate, biased, unavailable, or unsuitable in a particular situation. Where consent is required for a particular AI-assisted, recording, or transcription feature, EmployNext Alberta will seek that consent separately.
15. Optional Features and Separate Notices
Some features or service activities may be optional or may require separate notice, permission, or consent, including certain recordings, transcript-based supports, feedback activities, advanced digital tools, non-routine referrals, or feature-specific communications.
If you decline or later withdraw consent for an optional feature, that feature may be limited or unavailable. However, saying no to an optional feature will not by itself prevent you from using other available Services unless the activity is required to operate that specific service component or is otherwise required by law, policy, or program design.
16. Intellectual Property
Except for your own User Content and third-party materials used with permission, the online materials, service content, branding, software, tools, training materials, forms, documentation, designs, graphics, and other intellectual property made available through EmployNext Alberta are owned by EmployNext powered by Serco Canada Inc., the Province of Alberta, or their licensors, as applicable.
You may not copy, modify, reproduce, republish, distribute, sell, license, scrape, extract, create derivative works from, or otherwise use those materials except as expressly permitted by law or with our written permission.
17. Professional and Program Disclaimers
The Services are provided for informational, navigation, coordination, employment-related support, wrap around support and service-administration purposes only.
Nothing in the Services constitutes legal advice, immigration advice, medical advice, mental-health treatment, disability diagnosis, financial advice, employment law advice, or any other regulated professional advice.
You should seek independent professional advice where needed.
EmployNext Alberta makes no guarantee of employment, job retention, training acceptance, disability funding approval, income improvement, service continuation, or any specific program, referral, or service outcome.
18. Questions, Complaints, Service Concerns, and Privacy Concerns
EmployNext Alberta want concerns to be raised early and handled respectfully, fairly, and as quickly as reasonably possible.
If you have a question, concern, or complaint about your experience with EmployNext Alberta, you may speak with the staff member supporting you, ask to speak with a supervisor or manager, raise your concern through an EmployNext Alberta Resource Centers or service contact channel, or contact the Privacy Officer if your concern is not resolved or if it relates to privacy, records, consent, or information sharing.
If your concern is not resolved at the point of service, or if it involves privacy, confidentiality, records, consent, information sharing, or another serious issue, it may be escalated to the Privacy Officer at EmployNext Alberta

We will make reasonable efforts to acknowledge and review concerns in a timely manner, although response times may vary depending on the nature of the issue, verification requirements, and applicable legal or program processes.
Requests to access or correct information, or complaints about the handling of personal information, will be handled in accordance with applicable Alberta law, contractual requirements, approved systems, and internal procedures. Not all requests to change or remove records can be granted, particularly where records must be maintained for legal, audit, contractual, operational, or program-integrity reasons.
If you believe your privacy rights have been affected, you may also have the right to contact the Office of the Information and Privacy Commissioner of Alberta, depending on which law applies to the information involved.
Where a program policy or law provides a review, reconsideration, or complaint process for a decision affecting access, eligibility, records, or personal information, EmployNext Alberta may direct you to the applicable process
19. Suspension, Restriction, and Termination of Access
We may suspend, restrict, or terminate access to all or part of the Services at any time if you breach these Terms, create safety or security risks, misuse the Services, provide materially misleading information, violate applicable law, or where suspension or restriction is required for legal, contractual, privacy, operational, or safety reasons.
If access ends, you must stop using the affected Services. Certain provisions of these Terms will continue to apply after access ends, including provisions relating to records, privacy, intellectual property, disclaimers, liability, complaints, and legal compliance.
20. Indemnification
To the fullest extent permitted by law, you agree to indemnify and hold harmless EmployNext powered by Serco Canada Inc., its affiliates, officers, directors, employees, contractors, and agents from claims, liabilities, damages, losses, or costs arising out of your unlawful misuse of the Services, material breach of these Terms, or infringement of the rights of another person.
21. Limitation of Liability
To the maximum extent permitted by applicable law, EmployNext Alberta, Serco Canada Inc., and their affiliates, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, opportunity, goodwill, or profits arising from or related to the Services.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
22. Changes to These Terms
We may update these Terms from time to time by posting a revised version.
Changes take effect on the stated effective date unless otherwise indicated.
Your continued use of the Services after the effective date of revised Terms constitutes acceptance of the updated Terms
23. Governing Law and Venue
These Terms are governed by the laws of the Province of Alberta and the applicable laws of Canada.
Any disputes arising from or relating to these Terms or the Services will be brought exclusively in the courts of Alberta, unless applicable law requires otherwise.
24. Electronic Communications and Notices
You consent to receive electronic communications relating to the Services where consent for those communications is permitted or obtained as required.
We may provide notices by email, through the website or Services, by secure messaging, or through other contact methods you have provided, where appropriate.
You are responsible for maintaining reasonably current contact information if you wish to receive notices without delay.
25. Entire Agreement and Severability
These Terms, together with any incorporated Privacy Policy, feature-specific notice, consent, or other applicable posted terms, form the agreement between you and EmployNext Alberta regarding the subject matter they address.
If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force to the extent permitted by law.
26. No Waiver
Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
27. Assignment
You may not assign or transfer your rights or obligations under these Terms without our written consent. We may assign or transfer our rights or obligations where permitted by law or as part of an internal reorganization, service arrangement, or business transition.
28. Acknowledgement
By accessing or using any part of the Services, you acknowledge that you have read and understood these Terms and agree to them to the extent they apply to the website, Resource Centers, feature, communication channel, or Alberta service or service component you are using.
Where you participate in a program-related service component, you also acknowledge that participation may require the collection, use, storage, documentation, and sharing of certain personal information for lawful service delivery, coordination, reporting, accountability, and compliance purposes, as described in these Terms and the EmployNext Alberta Privacy Policy.
If a separate notice, consent, or authorization is required for a specific feature or activity, such as recordings, transcription, AI-assisted supports, or non-routine information sharing, EmployNext Alberta may provide that separately.
